PROPERTY RIGHTS COUNCIL

The PRC is a new concept that was borne out of Bonner County Idaho and is really picking up traction.  We have been investigating different ways to preserve personal property rights, and this seems to be the most comprehensive and result-driven way to do so.  

The mission of the Property Rights Council ("PRC") is to review county and or city government activities and inter-governmental activities to determine whether they may cause adverse impacts to private property rights.

The review process includes the following steps:

  • It is initiated by you (the public) contacting the PRC 
  • The PRC evaluates whether your proposal affects a department which has agreed to participate in the PRC advisory process.
  • If the affected department participates, then the PRC evaluates your proposal and makes a recommendation to the participating department.
The PRC conducts public meetings, workshops, and hearings to ensure it understands the regulatory framework of your proposal. The PRC also draws on free-market tools, and contacts experts (as needed) to support your property rights proposals, and to ultimately transmit your proposal to public officials for their consideration.

The PRC, unlike many governmental advisory boards, focuses on searching for private solutions instead of automatically proposing expanded government to solve societal problems.

NOTE: Pure questions of law are not appropriate for the PRC.  These questions should be submitted to private legal counsel.  The PRC evaluates proposals to amend existing laws or prevent new laws which unnecessarily interfere with private property rights.



THE PROBLEMS


The Government has several NGO's that participate in the planning process and then come in and support them while they are going through the process of trying to take possession of private property - what can the individual do?



Many times, the individual has no idea what the process is, or what they are actually allowed to do and not do.  They seem to take the government at their word.




The private property owner feels like they are all alone and gives in easily.

THE SOLUTIONS


The PRC can be the private property owners defense, not only in the planning process, but also during the public process.





The PRC is there to assist the private property owner in whatever they need.  The PRC knows the process and what can and cannot be done according to the United States Constitution.




The PRC can pick up much of the slack and give the individual all the proper tools to make the fight that much easier.
